The principal mode of entry for foreign direct investment is through the conclusion of state contracts: a foreign investment contract with the hosting State. Such contracts raise a number of specific issues that have direct consequences on international dispute settlement procedures, such as the definition of investment, so-called umbrella clauses and stabilization clauses. This course provides an opportunity to discuss key concepts of state contracts and their consequences on international investment dispute settlement. This class is taught in French. |
